Rental terms
Entry into effect
Rental will take effect as from reception of the equipment by the LEASER or upon delivery of the equipment by a transport company.. It will end when the equipment has arrived at the ABEM France premises.
The length of the rental period is determined between the LEASER and ABEM FRANCE. Any changes to the length of this period must be stipulated in writing.
Conditions of provision
All equipment, its accessories and everything that allows normal use of the said equipment will have been deemed to have been delivered to the LEASER, having recognized such delivery, in satisfactory working order and properly maintained. The LEASER must acknowledge the condition of the equipment at the time it is handed over. The LEASER must state any problems identified, so that they cannot be attributed to the LEASER by ABEM France when the equipment is handed back.
The LEASER undertakes that the equipment will be returned to ABEM France in a satisfactory condition of cleanliness and operation.
As the equipment will already have been used or will be second-hand, ABEM France does not guarantee the LEASER that it will not have to undergo repairs during the term of the contract.
ABEM France will not be held liable for any loss or damage caused to the LEASER or any third party subsequent to incorrect use or performance of the rented equipments. Taking possession of the equipment transfers legal custody of the equipment to the LEASER who undertakes under all circumstances to use the equipment in accordance with its intended purpose and the manufacturer's recommendations.
Shipment
The cost and expenses of shipment of the rental equipment, for both the outward and return journey, will be payable by the LEASER. If shipment is undertaken by ABEM France or a third party selected by it, the cost and expenses of this service will be billed to the LEASER. ABEM France will not be held liable for any delays in provision or delivery of the rented equipment, that are due to any reason beyond its. If the rented equipment is transported by a third party, ABEM France will not be held liable for any oversight of the shipper or for late delivery.
Technical support
ABEM France undertakes to provide the user LEASER with technical support, by telephone or through prior training, after agreement between the two parties. This training will include the use of the equipment, starting-up in the field, and acquisition and analysis of data. Any training dispensed at a site specified by the LEASER will be billed at the agreed price. Travel costs will be billed in addition (mileage, food and board).
Terms of payment
Our general terms of payment are net thirty (30) days, by bank transfer, as from the date of billing to the LEASER. Payment should be made in Euros. It is agreed that in the event of failure to pay one single rental instalment by its deadline, or in the event of failure to comply with any one of the conditions of these general rental conditions or special rental conditions, the rental contract will be duly terminated without delay if ABEM France so wishes, after having informed the LEASER by registered letter with recorded delivery, with no other formalities, of its intention to enforce this present clause.
